General terms and conditions

1. Scope

These general terms and conditions (Allgemeine Geschäftsbedingungen, AGB) apply to all contracts between MarketingAthlet LLC, Kirchplatz 8, 41334 Nettetal-Kaldenkirchen, Germany, represented by Tilo Bock (hereinafter the “Provider”), and its clients concerning services in the field of lead brokerage.

2. Scope of services

The Provider provides services exclusively in the field of lead brokerage.

The subject matter of the service is the generation and brokerage of qualified prospect data (leads) to insurance intermediaries and financial service providers.

Advisory services, sales services or a guarantee of closing a deal are not part of the contract.

3. Conclusion of contract

A contract is concluded by written or electronic order confirmation or by agreement over the phone.

Contracts concluded remotely by voice (e.g. by phone or video call) are legally effective.

4. Client's duty to cooperate

The client undertakes to provide all information necessary for carrying out the lead brokerage in good time. Delays due to a lack of cooperation are not the responsibility of the Provider.

5. Rights to work results

Upon payment in full, the client receives a simple (non-exclusive) right of use to the brokered leads. Resale or disclosure to third parties is only permitted with the Provider's express consent.

6. Remuneration, termination and late payment

(1) The agreed prices are net prices plus statutory VAT, where applicable.
(2) Invoices are due immediately upon receipt.
(3) In the event of late payment, the Provider is entitled to suspend the service.
(4) If two payments are in arrears, the entire remaining remuneration may be declared due immediately.
(5) Ordinary termination during agreed terms is excluded.
(6) Notices of termination must be given in writing.

7. Lead complaints

(1) A complaint about a lead is only possible within a reasonable period after transmission.
(2) In the case of a justified complaint, there is no entitlement to a refund of the lead price.
(3) Instead, the Provider supplies a new, fresh and equivalent replacement lead.
(4) Any claim to payment or offsetting in monetary form is excluded.

8. Dates and deadlines

Delivery dates for leads are non-binding unless they have been expressly agreed as binding in writing.

9. Liability

The Provider is only liable in cases of intent or gross negligence. Any liability for economic success or for a contract being concluded between the client and a lead is excluded.

10. Data protection

Personal data is processed in compliance with the applicable data protection regulations. Further information can be found in the privacy policy.

11. Use as a reference

After successful cooperation, the Provider is entitled to name the client as a reference, unless the client expressly objects.

12. Final provisions

The law of the Federal Republic of Germany applies.

The place of jurisdiction for all disputes arising from the contractual relationship is Hanover (Hannover), insofar as permitted by law.

Should individual provisions of these terms and conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
